Terms and Conditions

Audition by Smokey Mountain 2026 — Please read these terms carefully before submitting your audition.

These Terms and Conditions govern your participation in Audition by Smokey Mountain 2026, an open audition organized by Smokey Mountain Music Company to identify and recruit five (5) talented Asian Muslim male singers between the ages of 14 and 17 to form the next generation of the legendary singing group Smokey Mountain. By submitting an audition, you — and your parent or legal guardian — agree to be bound by these terms in their entirety.

1. Eligibility Requirements

1.1 Age & Faith

The Audition by Smokey Mountain 2026 competition is open exclusively to Asian Muslim males ages 14 to 17.

1.2 Nationality

The audition is open to applicants of all nationalities worldwide. There is no geographic restriction.

1.3 Disqualification

Any applicant found to have misrepresented their age, faith, identity, or submitted fraudulent materials will be immediately disqualified and may not reapply in future cycles. Smokey Mountain Music Company reserves the right to disqualify any submission at its sole discretion.

2. Submission Rules

2.1 Video Requirements

Each applicant must submit one (1) video of themselves singing. The video should be no longer than sixty (60) seconds in duration. The applicant must be clearly visible and audible throughout the video.

2.2 Technical Specifications

Accepted video formats include MP4, MOV, AVI, and WEBM. Maximum file size is 100 megabytes (100MB). Videos of poor audio quality, heavily filtered, digitally pitch-corrected beyond natural enhancement, or that contain lip-syncing to a pre-recorded track may be disqualified.

2.3 Song Selection

Applicants may perform any song of their choice — original compositions and cover versions are both accepted. Smokey Mountain Music Company takes no responsibility for copyright claims arising from cover performances submitted for this audition.

2.4 One Submission Per Applicant

Each applicant may submit only one (1) audition entry. Multiple submissions from the same individual may result in all entries being voided.

2.5 Submission Deadline

All submissions must be received by June 30, 2026. Smokey Mountain Music Company reserves the right to extend the submission deadline.

3. Selection Process

3.1 Panel Review

All valid submissions will be reviewed by the Smokey Mountain Audition Selection Panel, which includes members appointed by Smokey Mountain Music Company and may include mentor Ryan Cayabyab (National Artist of the Philippines for Music). The panel's decisions are final and binding.

3.2 Shortlisting

Up to twenty (20) applicants may be shortlisted for further evaluation, which may include virtual callbacks or in-person auditions at a location to be determined by Smokey Mountain Music Company. Shortlisted applicants will be notified via the email address provided in their application within four (4) weeks of the submission deadline.

3.3 Final Selection

Five (5) applicants will be selected as members of the new Smokey Mountain ensemble. Selected members will enter into a separate Artist Agreement with Smokey Mountain Music Company.

4. Intellectual Property & Media Rights

4.1 Ownership of Submission

By submitting an audition video, applicants grant Smokey Mountain Music Company a worldwide, royalty-free, non-exclusive license to use, reproduce, display, and distribute the submitted video for promotional, marketing, and archival purposes related to Audition by Smokey Mountain 2026. This includes use on the official website, social media channels, press materials, and broadcast media.

4.2 Attribution

Smokey Mountain Music Company will provide reasonable attribution to the applicant when using their submitted video publicly. However, the applicant acknowledges that attribution may not always be practical in all formats.

4.3 No Compensation

Submission of an audition video does not entitle the applicant to any monetary compensation for the use of the video under the license granted in Section 4.1.

5. Privacy and Data Protection

5.1 Data Collection

Smokey Mountain Music Company collects personal information including but not limited to the applicant's name, date of birth, contact information, nationality, and the guardian's contact details. This information is used solely for the purpose of administering the Audition by Smokey Mountain 2026 competition.

5.2 Data Storage

Personal data will be stored securely and retained for a period of twelve (12) months after the competition concludes, after which it will be securely deleted unless otherwise required by applicable law or the applicant has entered into a further agreement with Smokey Mountain Music Company.

5.3 Third-Party Sharing

Personal data will not be sold or shared with third parties for commercial purposes. Data may be shared with authorized partners assisting in the administration of the competition (e.g., technical platform providers) under confidentiality agreements.

6. Conduct and Disqualification

6.1 Respectful Conduct

All applicants, guardians, and associated parties are expected to conduct themselves with respect and integrity throughout the audition process. Any harassment, intimidation, or inappropriate behavior directed at panel members, staff, or other applicants will result in immediate disqualification.

6.2 Islamic Values

In alignment with the faith-centered nature of this project, all submitted content must be consistent with Islamic values and principles. Content deemed offensive, immodest, or contrary to Islamic ethics will be disqualified.

6.3 Appeals

There is no formal appeals process for disqualification decisions. All decisions made by Smokey Mountain Music Company and the Selection Panel are final.

7. Limitation of Liability

7.1 Technical Issues

Smokey Mountain Music Company is not responsible for any technical failures, internet connectivity issues, server downtime, or any other technical circumstances that prevent a timely or complete submission. Applicants are encouraged to submit well before the deadline.

7.2 Expenses

Smokey Mountain Music Company is not liable for any costs incurred by applicants or their guardians in connection with the preparation, recording, or submission of an audition, unless explicitly agreed to in writing.

8. Amendments and Governing Law

8.1 Right to Amend

Smokey Mountain Music Company reserves the right to amend these Terms and Conditions at any time. Any amendments will be posted on the official Smokey Mountain Audition website. Continued participation after amendments constitutes acceptance of the updated terms.

8.2 Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of the Republic of the Philippines.

8.3 Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
